On 6th August 2020 the European Commission has adopted and released its “COMMISSION DELEGATED REGULATION (EU) …/... amending Delegated Regulation (EU) 2018/985 as regards its transitional provisions in order to address the impact of the COVID-19 crisis”.

The draft text takes into account the changes put forward by the amendment of the non-road mobile machinery Regulation (EU) 2016/1628 through Regulation (EU) 2020/1040. The legal basis of this delegated act is Regulation (EU) No 167/2013 of the European Parliament and of the Council of 5 February 2013 on the approval and market surveillance of agricultural and forestry vehicles.

As a delegated act, the text is currently going under scrutiny from the Member States and the European Parliament, and it will only become law when the scrutiny is over (this process is expected to take no longer than 2 months). Regulation (EU) 2020/1040 still applies in any case to agricultural and forestry vehicles, even without this new delegated act and with an obsolete Commission Delegated Regulation (EU) 2018/985.
